(Republican Party News) – An attorney who represents the family of Ashli Babbitt has stated that they plan to file a lawsuit against the U.S. Capitol Police after one of their officers shot and killed her during the siege on the Capitol building that took place on January 6th of this year.
A new report from The Epoch Times says that no charges were fired against the officer who opened fire on Babbitt. The officer involved in the shooting has not been publicly identified either.
Babbitt, a former U.S. Air Force veteran, was not armed at the time of the shooting when she tried to climb through one of the Capitol doors before being shot by the unnamed officer.
“The family and I were disappointed in the Department of Justice’s decision on this, but my role is really to bring a civil action and in that way, vindicate her rights,” Terry Roberts said to conservative news network Newsmax on Monday.
“The Babbitt family, he said, disagrees with the Department of Justice’s move to not pursue criminal charges against the officer, adding ‘clearly, the officer a required willfulness … he could clearly see that she was not armed’ and didn’t present an immediate threat. The officer also didn’t give ample warning before the shooting, Roberts said,” the EP report said.
“This is a situation in which the officer could have easily arrested her if he had grounds to arrest her without using deadly force,” Roberts went on to say. “This was an egregious act of excessive force.”
Roberts then went on to suggest that the reason no charges were filed against the officer is due to the fact that Babbitt was a Trump supporter.
The lawsuit in question could discuss complaints of excessive use of force.
Roberts said, “That will be filed against the officer, the Capitol Police.”
An investigator claims to have successfully identified witnesses that were spoken to along with the efforts of a team that spent weeks gathering open source video and photographs of the shooting to try and reconstruct what happened in the moments just leading up to the shooting.
“Witnesses confirm that the officer did not give Ashli a single verbal warning prior to firing. In fact, Ashli was not even aware that the officer was present, as he was located in the doorway of a room off to the side of her field of vision,” Roberts went on to add.
